A trademark is one of the most valuable intellectual property assets for any business. In India, trademarks are registered under the Trade Marks Act, 1999 and administered by the Office of the Controller General of Patents, Designs and Trade Marks.

Step 1: Trademark Search

Before filing, a comprehensive search of the trademark registry database must be conducted to ensure no conflicting marks exist in the same class.

Step 2: Application Filing

Applications can be filed online through the IP India portal. The filing fee is ₹4,500 for individuals and small enterprises, and ₹9,000 for others, per class.

Timeline

After filing, applications undergo examination within 1-3 months. If accepted, they are published in the Trademark Journal for 4 months for public opposition. If no opposition is filed, the trademark is registered.
